Often they are associated with violations that occur due to the lack of taxpayers’ awareness of the rapidly changing laws and regulations. Recognition of Tax Payments

Situation:

Our corporate client provided the bank with payment orders for his tax payments. The orders were accepted, the required amount was written off the account. Two days later, the Central Bank withdrew the bank’s license, and the money did not reach the tax office. After a month, the Inspectorate of the Federal Tax Service demanded that our client pay arrears and fines.

Our Actions:

Elena Latynova, the senior partner of KDS Legal, took legal action and demanded that the tax office recognises that the company fulfilled its tax obligations. We pointed out that the obligations are considered to be fulfilled if two conditions are met: the submission of a corresponding payment order to the bank and the availability of a sufficient balance of funds on the account. Meanwhile, our client could not have officially known that the bank was experiencing financial difficulties and was about to lose its license.

Result:

The court openly sided with us and declared that the organization was paying its taxes. The Inspectorate of the Federal Tax Service could not prove that the payment orders were deliberately submitted so as to reduce the balance of funds on the account in the troubled bank due to payments being made into the account.
